Terms of Service

Effective October 13, 2026 · Under attorney review. The next version will be emailed to account owners at least 30 days before it takes effect.

These Terms are a contract between you and Flote Quote LLC, doing business as FloteQuote (“FloteQuote,” “we,” “us”), Pensacola, Florida. They cover the FloteQuote software (the “Service”) and this website. “You” means the business that signs up. By creating an account you confirm that you are authorized to bind that business. The Service is sold to businesses only, not to consumers.

1. What FloteQuote is

FloteQuote helps home-service companies collect job details and photos from homeowners, price jobs, send proposals, and follow up. It includes a quote page you share with customers, an app for your team, and Floyd, an AI assistant. We improve the Service over time and will give reasonable notice before removing anything central to what you pay for.

2. Your account

  • Give us accurate information and keep it current. You are responsible for everyone you give a login to and for what they do in your account.
  • The person who creates the account is the Account Owner. The Account Owner controls billing, team logins, data export, and cancellation.
  • Keep your password private. Tell us at [email protected] right away if you think someone else has access.

3. Subscription, renewal, and cancellation

  • Month to month. Your subscription renews automatically every month and is charged to the card or bank account on file on your billing date until you cancel. Before your first charge we show you the price, the billing date, and how to cancel, and we ask you to agree.
  • Price. The monthly price, any extra team logins, integrations, and setup work are stated on your order or payment link. Prices are in U.S. dollars. Taxes may be added where required.
  • Cancel any time. Email [email protected] from the Account Owner’s email address. We confirm by email. Cancellation takes effect at the end of your current billing period. You keep access until then, you are not charged again, and partial months are not refunded.
  • Free trials. If your plan starts with a free trial, we tell you when it ends and what you will be charged.
  • Price changes. We give at least 30 days’ notice by email. You may cancel before a new price takes effect.

4. Failed payments and refunds

If a charge fails we retry it and email you. If it stays unpaid for 14 days we may suspend access, and after 30 more days we may close the account. Fees are non-refundable except where these Terms say otherwise or the law requires it. If you think a charge is wrong, email us within 60 days and we will review it in good faith; please contact us before disputing a charge with your bank.

5. Payments you collect through FloteQuote

If you turn on FloteQuote Payments, your customers’ card and bank payments are processed by Stripe under your own Stripe connected account and Stripe’s terms. FloteQuote is not a bank and never holds your customers’ money. For each payment collected through FloteQuote Payments you pay a processing fee of 2.99% for standard cards, 3.49% for premium cards, and 1% for bank (ACH) payments, deducted before payout. International cards may carry an additional 1.5%. That fee includes Stripe’s processing cost. Payments you collect outside FloteQuote carry no fee. Refunds, chargebacks, and dispute fees on your customers’ payments are your responsibility, as are any surcharges you choose to add and their legality.

6. Your data

  • You own it. Everything you and your team put into FloteQuote, including your customers’ names, contact details, addresses, photos, notes, prices, and quotes (“Customer Data”), belongs to you.
  • We only use it to serve you. We host and process Customer Data to run, secure, and support the Service, to carry out your instructions (including integrations you turn on), to prevent abuse, and to comply with the law. We do not sell it, we do not use it to advertise to your customers, and we do not use it to train AI models.
  • You are responsible for having the right to collect it, for any notices or consent your customers are owed, for the accuracy of your quotes, and for not uploading Social Security numbers, card numbers, medical details, or information about children.
  • Export. The Account Owner can download leads and invoices as CSV files from Settings at any time, or ask us for a full export.
  • After you leave. You may request an export for 30 days after your account ends. After that we delete Customer Data from the live Service, keeping only the billing records the law requires.
  • If there is a breach affecting your Customer Data, we notify the Account Owner without unreasonable delay and no later than 10 days after we learn of it.

7. AI features

Floyd uses AI providers to write quote ranges, proposal text, follow-up messages, review replies, and market research. For a specific quote or message, the customer’s answers, photos, and notes are sent to our AI provider (Anthropic) to produce the result; market research sends company and market information, not customer names. We use these providers under business terms that do not permit training on your data. AI output can be wrong. Floyd’s prices are ranges, not quotes. You are responsible for reviewing every price, proposal, and message before it goes to a customer.

8. Acceptable use

Do not use the Service to break the law or mislead anyone; send spam or messages without the consent the law requires; upload content that infringes someone’s rights; attack, probe, or overload the Service; copy or resell it; or share logins. Messages you send to your customers come from you, from your own phone and email, and you are responsible for them. We may suspend an account that breaks these rules, and where reasonable we will warn you first.

9. Integrations

You may connect third-party tools such as Zapier, Google Business Profile, and Stripe, and website forms. When you do, you are telling us to exchange data with that tool, and its own terms and privacy policy apply to it. We are not responsible for third-party services. Our use of Google data follows the Google API Services User Data Policy, including its Limited Use requirements.

10. Ownership

We own the Service, its software, templates, and the FloteQuote name and logo. You get a limited right to use it for your business while you subscribe. You keep your own logo, branding, and Customer Data. If you send us suggestions we may use them. We will not name you as a customer in our marketing without your permission.

11. What we promise, and what we do not

We provide the Service with reasonable skill and care and substantially as described. Otherwise the Service is provided “as is” and “as available,” and to the fullest extent allowed by law we disclaim all other warranties, including merchantability and fitness for a particular purpose. We do not promise uninterrupted service or that it will win you any job. FloteQuote is a tool: it does not give legal, tax, licensing, engineering, or pricing advice. Keep your own copies of important records.

12. Limits on liability

To the fullest extent allowed by law, neither of us is liable to the other for lost profits, lost business, or indirect, incidental, special, consequential, or punitive damages. Each party’s total liability under these Terms is limited to the fees you paid us in the 12 months before the claim. These limits do not apply to your obligation to pay fees, to either party’s fraud, gross negligence, or willful misconduct, or to anything the law does not allow us to limit.

13. Indemnity

You will defend us and cover resulting damages and reasonable attorneys’ fees if a third party, including one of your customers or a regulator, brings a claim arising from your Customer Data, messages you send, your work or quotes, or your breach of Section 8. We will defend you if a third party claims the Service itself infringes a U.S. patent, copyright, or trademark, except where the claim comes from your data, integrations, or misuse.

14. Ending the relationship

You may cancel as described in Section 3. We may suspend or close your account for non-payment (Section 4), for a material breach you do not fix within 10 days of our notice, immediately for a serious security or legal risk, or for any reason on 30 days’ notice with a refund of any prepaid, unused fees. Fees owed through the end date stay due. Sections 5, 6, 10 through 13, and 16 survive.

15. Changes to these Terms

This is an interim version while our attorney completes a full review. When we make a material change we email the Account Owner and post the new version at least 30 days before it takes effect. If you do not agree you may cancel before then, and we will refund any prepaid, unused fees. Continuing to use the Service after the change means you accept it.

16. Law, disputes, and notices

These Terms are governed by Florida law. Before filing any claim, the party with the claim will send the other written notice and both will try in good faith to resolve it within 30 days. Disputes not resolved go to the state courts in Escambia County, Florida, or the United States District Court for the Northern District of Florida, and each party consents to those courts. Both parties waive a jury trial to the extent the law allows. Either party may bring a qualifying claim in small claims court. Legal notices to us go to [email protected] and to Flote Quote LLC, 418 W Garden St, Suite 308, Pensacola, FL 32502; notices to you go to the Account Owner’s email. We are independent contractors. If a court finds part of these Terms unenforceable, the rest still applies.
